Musterly is a workplace presence and safety service operated by Brix Systems Limited, trading as Musterly. We are registered in England and Wales under company number 17123063.
These terms apply to the Musterly website and application. By creating an account or using the service, you agree to them. If you use Musterly for an organisation, you confirm that you have authority to accept these terms for that organisation.

The service may include trial access, self-service setup and assisted setup. Features available to an organisation may depend on its subscription and configuration.
Musterly is intended for organisations. Each organisation is responsible for:

You must use Musterly lawfully and responsibly. You must not:
We may restrict or suspend access where reasonably necessary to protect the service, our customers or other people, or to comply with law.
You and your organisation keep your rights in information submitted to Musterly. You give us permission to process that information as needed to provide, secure and support the service. Our Privacy Notice explains how personal information is handled.
The main Musterly application database is hosted in the European Union. We access an organisation's application data only as needed to provide and secure the service, deliver support requested by the organisation, or comply with law.
After cancellation, an organisation normally has 30 days to export its data. We then delete the data, subject to any legal requirement to keep limited records for longer.
Musterly can connect to third-party services, including supported access-control systems. Your organisation is responsible for having permission to connect those services and for complying with the third party's terms.
Unless we say otherwise, Musterly is not affiliated with or endorsed by third-party access-control providers. We are not responsible for changes, outages or errors in a third-party service that are outside our control.
We aim to provide a reliable service, but we cannot guarantee that Musterly will always be available or error-free. We may carry out maintenance, make updates, change features or experience outages. Where practical, we will give notice of planned downtime that is likely to have a material effect.
Musterly supports workplace safety processes but does not replace an organisation's legal duties, emergency procedures, professional judgement or primary life-safety systems.
To the maximum extent permitted by law, Brix Systems Limited is not liable for indirect or consequential loss arising from use of Musterly, including loss of revenue, loss of data or reliance on presence and roll-call information for safety-critical decisions.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.
Musterly's software, design, trademarks and content belong to Brix Systems Limited or its licensors. These terms give you a limited right to use the service for your organisation. They do not transfer ownership of our intellectual property to you.
The laws of England and Wales govern these terms. The courts of England and Wales have exclusive jurisdiction over disputes relating to them.
We may update these terms when the service or legal requirements change. We will give reasonable notice of material changes by email, in the application or on the website. If you continue to use Musterly after the updated terms take effect, the updated terms will apply to that use.
